As I mentioned in Episode 1, few of you are regulated by the EPA. This means that it is up to the individual state environmental department to determine what will be done as a response to the shelter-in-place orders given by each state’s governor.

It is business as usual in New York and Maryland. 

Swift action is being taken to ensure all industrial facilities understand the NYDEC is not compromising any regulations and will still maintain normal requirements with the exception of special authorizations. MDE has not made any statements regarding the relaxation of regulations, but instead offered special exceptions for authorizations that are expiring while the shelter-in-place order is in effect.

Special authorizations don’t impact most of you, so when you see that regulations are relaxing this is not necessarily the case. As a company, we are seeing a rise in violation notices as states capitalize on people assuming the rules have been relaxed and the need to collect funds. Contrary to popular belief, enforcement has been increased by the US EPA for sampling in New York.  JEM is also seeing increased monitoring of the Chesapeake Bay Restoration Program by MDE with enforcement of facility compliance plans.
